E‐mail and Personally Identifying Information

DHI respects the privacy of its readers. DHI uses AWStats to analyze traffic to this web site. AWStats does not create individual profiles for visitors. Unlike some tracking services AWStats does not have a database of individual profiles for each visitor. AWStats only collects aggregate data. All E‐mail lists maintained by DHI contain the names of people who request to receive information from us. DHI may use such information for marketing and promotional purposes and may share the information with companies that it has pre‐screened. Individuals always have the ability to stop their information being used for such purposes by sending an e‐mail request to membership@dhi.org. A user's personal identifying information will not be transferred to any other party unless otherwise stated at the time of collection. While DHI will seek to require third parties with whom it has agreements to follow appropriate privacy policies, we do not bear any responsibility for any actions or policies of such third parties. DHI may disclose personal identifying information about you to third parties as follows:

To DHI’s agents and advisors (such as our accountants or attorneys). We only disclose the personal information necessary for them to provide their services to you or to us, and only under strict confidentiality restrictions.
As DHI believes necessary to: (a) comply with law (including court and government orders, and civil subpoenas); (b) enforce or apply this Agreement; or (c) protect the rights, property, or safety of DHI, our users, or others. d) If you partake (or we reasonably suspect that you are partaking) in any illegal or potentially illegal activity. We may disclose personal information even without a subpoena, warrant, or other court order, to the extent we feel is necessary to inform and cooperate with law enforcement agencies or other appropriate authorities. e) In aggregated form, i.e., information about multiple users collectively without identifying any individual user, such as the total number of visitors to a particular section in a given week.

Modification

DHI shall have the right, at its discretion, to change, modify, add or remove terms of this agreement at any time without notice. Changes shall be effective immediately. You agree to review this agreement periodically since subsequent use by you of this site shall constitute your acceptance of any changes. DHI shall have the right at any time to change or discontinue any aspect of the web site, including, but not limited to, the membership areas, content, hours of availability and equipment needed for access to use. Such changes, modifications, additions or deletions shall be effective immediately upon posting and any subsequent use by you after such posting shall conclusively be deemed to be acceptance by you of such changes, modifications or deletions.

Termination

This agreement is effective until terminated by DHI, at any time without notice. In the event of termination, you are no longer authorized to access the Discussion forums and the restrictions imposed on you with respect to material downloaded from the Discussion forums, the disclaimers and limitations of liabilities set forth in this agreement, shall survive.

Under no circumstances shall DHI, its officers, directors, employees, members, agents or its chapters be liable for any direct, indirect, incidental, special or consequential damages (even if it had been advised of the possibility of such damages) that result from the use of, or the inability to use, DHI materials and services. You specifically acknowledge and agree that DHI is not liable for any conduct of any User. As a condition of use of this Web site, the User agrees to indemnify DHI its officers, directors, employees, members, agents, chapters and its suppliers from and against any and all liabilities, expenses (including attorneys' fees) and damages arising out of claims resulting from User's use of this Web site, including without limitation any claims alleging facts that if true would constitute a breach by User of these terms and conditions. If you are dissatisfied with any DHI material, or with any of DHI's terms and conditions, your sole and exclusive remedy is to discontinue using the DHI Web site.
